These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you" or "your") and Hyperflops GK (Godo Kaisha), a company organized and existing under the laws of Japan ("Company", "we", "us", or "our"), governing your access to and use of the FateSign application, website, and related AI-powered metaphysics and astrology services (collectively, the "Service").

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

1. NATURE OF SERVICE & DISCLAIMER

1.1 Entertainment Purposes Only.

The Service utilizes Artificial Intelligence (AI) to provide astrological, Bazi, and metaphysical insights. You explicitly acknowledge and agree that the Service is for entertainment and emotional support purposes only.

1.2 No Professional Advice.

The content generated by the Service does NOT constitute professional psychological counseling, medical advice, legal counsel, or financial investment advice. The Company makes no representation or warranty regarding the accuracy, reliability, or predictive capability of the AI outputs. If you are experiencing a mental health crisis or medical emergency, please contact a qualified professional immediately.

1.3 AI Limitations & Third-Party Dependency.

You understand that the Service uses large language models which may produce "hallucinations," inaccuracies, or offensive content unintentionally. Furthermore, the Service relies on third-party AI service providers (e.g., OpenAI, Anthropic) and cloud infrastructure. The Company is not liable for any service interruptions, delays, or failures caused by these third-party integrations.

1.4 Prompt Inputs and Privacy.

While the Service requires certain metadata (such as birth dates or times) to function, you are strictly prohibited from inputting highly sensitive personally identifiable information (PII) such as real names, national ID numbers, or financial details into the AI chat interface. You acknowledge that your text prompts are processed using third-party AI models, and you assume all risks associated with the information you choose to share in your prompts.

2. ELIGIBILITY & ACCOUNT

2.1 Age Requirement.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

2.2 Account Security.

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized access to your account.

3. SUBSCRIPTIONS & PAYMENTS

3.1 Fees.

Certain features of the Service are available only through a paid subscription or one-time purchase ("Paid Services"). You agree to pay all fees associated with your selected plan.

3.2 Automatic Renewal.

Unless you cancel your subscription before the end of the current billing period, your subscription will automatically renew. You authorize us to charge the applicable subscription fee to your payment method.

3.3 Refunds.

Except as required by applicable law (including the Consumer Contract Act of Japan), all fees are non-refundable.

4. PROHIBITED CONDUCT

4.1 General Prohibitions.

You agree not to:

• Use the Service for any illegal purpose or in violation of any local, state, national, or international law.

• Input prompts designed to generate violent, pornographic, hateful, or illegal content.

• Attempt to "jailbreak," reverse engineer, or perform prompt injection attacks against the AI model.

• Use the Service outputs to scam, mislead, or defraud others.

• Automate the use of the Service (e.g., using bots or scrapers) without our written permission.

4.2 Anti-Social Forces Exclusion.

You represent and warrant that you are not, and have never been, a member of an organized crime group, a corporate extortionist, or any other anti-social force (collectively, "Anti-Social Forces") as defined under Japanese law. The Company reserves the right to immediately terminate your account without notice or refund if it is discovered that you belong to or are affiliated with any Anti-Social Forces.

5. INTELLECTUAL PROPERTY

5.1 Our Rights.

The Service, including its software, algorithms, UI, and trademarks, is the exclusive property of the Company.

5.2 User Content.

You retain ownership of the text prompts you input. Subject to these Terms, the Company grants you a non-exclusive license to use the text outputs generated by the Service for your personal, non-commercial use.

6. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Service, your violation of any applicable laws, or your infringement of any rights of a third party.

7. LIMITATION OF LIABILITY

7.1 General Disclaimer.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED.

7.2 Liability Cap.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW (INCLUDING THE CONSUMER CONTRACT ACT OF JAPAN): (A) THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. (B) OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE LIMITED TO THE GREATER OF: (I) THE TOTAL AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (II) ONE THOUSAND JAPANESE YEN (¥1,000 JPY) IF YOU ARE A FREE USER.

7.3 Exception for Gross Negligence.

NOTWITHSTANDING THE FOREGOING, NOTHING IN THESE TERMS LIMITS OUR LIABILITY FOR DAMAGES CAUSED BY OUR INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE (AS DEFINED UNDER JAPANESE LAW).

8. GOVERNING LAW & JURISDICTION

8.1 Governing Law.

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles.

8.2 Jurisdiction.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.

9. CHANGES TO TERMS

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
